GroupSat Limited Warranty Certificate

GroupSat^® provides limited warranties to purchasers of GroupSat products. Your GroupSat product includes the limited warranty described below. The length and term of the warranty varies. You may determine your GroupSat product's warranty from the label on its back or from the warranty information chart below. If your GroupSat product is not listed, please contact GroupSat at the number given below.

NOTE: All limited warranties are subject to the terms described in Sections 2 and 3 below.

SECTION 1. LIMITED WARRANTY DESCRIPTIONS

The limited warranty information chart above summarizes the limited warranties that apply to GroupSat products, which are fully described in this section: NOTE: All limited warranties are subject to the terms described in sections 2 and 3 below.

A. Materials and Workmanship Limited Warranty: If a GroupSat product comes with a Materials and Workmanship Limited Warranty, GroupSat warrants only to the original purchaser, and only for the time period beginning on the date of the GroupSat product's initial purchase from a GroupSat dealer or distributor and continuing for the term of the limited warranty stated in the table above.

• The product will be free from defects in materials and workmanship.
• If a defect exists during the term of the warranty, then GroupSat will, at its sole option, repair the GroupSat product, replace it with an equivalent product, or refund the purchase price.

B. Power Output Limited Warranty: If a GroupSat product comes with a Power Output Limited Warranty, GroupSat warrants to the original purchaser that under standard GroupSat test conditions, the GroupSat product will produce the warranted percentage of the minimum power output specified in applicable written GroupSat specifications.

C. This warranty will begin on the date of the GroupSat product's initial purchase from a GroupSat dealer or distributor and will continue for the term of the limited warranty stated in the table above. If GroupSat determines, using standard GroupSat test conditions, that the GroupSat product is not providing the warranted percentage of its specified minimum power output during the term of the warranty, then GroupSat will, at its sole option, repair the GroupSat product, replace it with an equivalent product, or provide additional components to bring the aggregate power output to at least the warranted percentage of the specified minimum power output.

SECTION 2. GENERAL INFORMATION  

The following terms apply to ALL WARRANTED GROUPSAT PRODUCTS:

• GroupSat may, at its sole option, use new, remanufactured, or refurbished parts or products when repairing or replacing a GroupSat product under warranty. Replaced parts or products will become GroupSat’s property.
• GroupSat is not responsible for, and the purchaser of the GroupSat product must pay, the costs of any on-site labor and any costs associated with the installation, removal, reinstallation, or transportation of the GroupSat product or any components for service under the limited warranty.
• The warranties apply only so long as the GroupSat product is owned by the initial purchaser of the product from a GroupSat dealer or distributor. The initial user must have purchased the GroupSat product for its, his, or her own use, and not for purposes of resale. In all cases, original proof of purchase must be provided when requesting warranty service.

SECTION 3. WARRANTY EXCLUSIONS AND LIMITATIONS

The following exclusions and limitations apply to ALL WARRANTED GROUPSAT PRODUCTS:

A. GroupSat‘s limited warranties do not cover damage, malfunctions, or service failures caused by:

• Failure to follow GroupSat installation, operation, or maintenance instructions;
• Repairs, modifications, or movements of a GroupSat product by someone other than a service technician approved by GroupSat;
• Attachment of a GroupSat product to non- GroupSat equipment;
• Abuse, misuse, or negligent acts;
• Power surges, lightning, fire, flood, pest damage, accidental breakage, actions of third parties, and other events or accidents outside GroupSat‘s reasonable control and not arising under normal operating conditions; and Breakage of laminates when mounted in unapproved mounting systems.

B. GroupSat makes no warranties, express or implied, other than the warranties made in this warranty certificate. GroupSat specifically disclaims any warranty of merchantability or fitness for a particular purpose.  To the extent warranties of merchantability or fitness for particular purpose cannot be effectively disclaimed by this warranty certificate, they are limited in duration to the term of the Materials and Workmanship Limited GroupSat Solar Limited Warranty Certificate.

C. GroupSat is not responsible for any incidental, consequential, or punitive damages arising from the use, loss of use, or failure of a GroupSat product to perform as warranted. Under this exclusion GroupSat is not responsible for damages for lost services, costs of substitute services, lost profits or savings, or expenses arising out of third-party claims. GroupSat‘s maximum liability under any warranty, expressed,  implied, or statutory, for any manufacturing or design defects, is limited to the purchase price of the GroupSat product.

D. If the initial purchaser of a GroupSat product purchased the product in a country or state with laws limiting the applicability of provisions or exclusions contained in this warranty, the provisions which have applicability that is limited by law will be limited or deleted, but only to the extent required by such laws. All other provisions remain in full force. Except as stated in the next sentence, any claim or dispute arising  under or in connection with this warranty certificate must be brought in the courts of the State of Arizona, U.S.A. under the laws of the State of Arizona. If the GroupSat product was purchased from a GroupSat dealer or distributor located in a member state of the European Union or in the country of Australia, any claim or dispute arising from or in connection with GroupSat’s warranty must be brought in the courts of London, UK, under the laws of the United Kingdom.
